SAVCA Master-Classes in Competition Regulation:
Developments in South African competition legislation and regulation and their implications for private equity
The Southern African Venture Capital and Private Equity Association (SAVCA), together with Webber Wentzel, are hosting two half-day master-classes that provide insight into recent trends in competition regulation in South Africa, with a focus on the economic and legal principles behind regulatory action. Emphasis will be placed on the implications for merger-and-acquisition activity and private equity transactions. Speakers:

SESSION ONE Abuse of dominance – the next priority for the Competition Commission? Implications for investors This three-hour session will focus on:
- Prohibited practices within the legal concept of “Abuse of Dominance”
- Overview of past abuse of dominance cases (SAA, Telkom, Sasol, Senwes, Mittal Steel)
- Within this framework, which markets are likely to be targeted by the competition authorities
- The economic tests that the competition authorities apply to establish abuse of dominance
- Penalties and remedies (e.g. divestiture, pricing commitments)
- Preparing portfolio companies to meet the challenges and opportunities that arise from competition law remedies
